Debs v. United States

249 U.S. 211 (1919)

 

Decided the same day as Frohwerk, Debs upheld the conviction of Socialist Party presidential candidate Eugene Debs. In each of his two presidential runs, Debs won 900,000 votes. This tally is all the more impressive for his second run given that he was in prison serving time on the conviction upheld by the Court. Though fascinating as a historical matter, the case is not significant doctrinally as HolmesŐ opinion for a unanimous Court essentially follows Frohwerk and Schenck. It is a squib in Sullivan & Feldman.
