The 1787 Order Restored (1871-1906)

Map 2 visualizes Part I.B of the article ("The 1787 Order Restored"). In this section, we show how the Supreme Court effectively restored the 1787 constitutional order by interpreting Reconstruction legislation by reference to a Confederate narrative of federalism.

In chronological order, the cases giving rise to the Supreme Court opinions on the map are: Blyew v. United States, 80 U.S. 581 (1871); Slaughter-House Cases, 83 U.S. 36 (1873); United States v. Reese, 92 U.S. 214 (1876); United States v. Cruikshank, 92 U.S. 542 (1876); United States v. Harris, 106 U.S. 629 (1883); Civil Rights Cases, 109 U.S. 3 (1883); Hodges v. United States, 203 U.S. 1 (1906).
